1. What OptimaPoker is

OptimaPoker ("the Software") is a poker training application. It simulates poker games against computer opponents and provides strategy education. The Software does not offer, facilitate, or connect to real-money gambling of any kind, hosts no games between real people, and involves no wagering, prizes, or currency — virtual chips have no monetary value.

2. Acceptance

By downloading, installing, or using the Software or this website, you agree to these Terms. If you do not agree, do not use the Software.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Software.

4. License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Software for your own poker study. You may not: (a) redistribute, resell, rent, or publicly host the Software; (b) reverse engineer, decompile, or extract its models, charts, or solver outputs except where such restriction is prohibited by law; (c) use the Software to build a competing product or dataset; (d) use the Software in violation of any applicable law or any poker platform's terms (see Section 6).

5. Early access; future paid plans

During early access the Software is provided free of charge. We may later introduce paid licenses or subscriptions; any such change will apply prospectively, be clearly announced, and be governed by updated terms presented at purchase. Early-access versions may change, break, or be discontinued at any time.

6. Fair-play responsibility

OptimaPoker is a study tool for use away from the tables. Many poker sites prohibit the use of real-time assistance software during online play. You are solely responsible for complying with the rules of any platform you play on. We do not endorse and did not design the Software for real-time use alongside third-party poker platforms.

7. Intellectual property

The Software, including its coaching models, opponent engines, charts, text, and design, is owned by OptimaPoker and protected by copyright and other laws. These Terms grant you no ownership rights.

8. No professional advice; no guaranteed results

Strategy output is educational information, not financial advice. Poker involves variance and skill; we make no promises about your results, win rates, or profits.

9. Disclaimer of warranties

THE SOFTWARE AND WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPTIMAPOKER AND ITS CREATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SOFTWARE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM (OR $10 IF YOU PAID NOTHING).

11. Changes

We may update these Terms; material changes will be reflected by the date above. Continued use after changes constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the United States and the state of the operator's residence, without regard to conflict-of-law rules.
